1. Informacje podstawowe

     Dane osobowe Kandydatów przetwarzane są przez Administratora zgodnie z obowiązującymi przepisami prawa, w szczególności zgodnie z rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) – dalej jako “RODO”.
     
     Gwarantujemy poufność wszystkich przekazanych nam danych osobowych. Stosujemy odpowiednie zabezpieczenia ochrony danych poprzez stosowanie środków technicznych i organizacyjnych, dzięki którym możemy zapewnić, że dane są w odpowiedni sposób chronione przed dostępem do nich osób nieuprawnionych.

2. Cele i podstawy prawne przetwarzania
   
   Będziemy przetwarzać Twoje dane osobowe, które nam prześlesz w celach:
   1. przeprowadzenia procesu rekrutacji – w oparciu o:
      • niezbędność do realizacji procesu rekrutacji na podstawie art. 22(1) ustawy z dnia 26 czerwca 1974 r. – Kodeks pracy– w przypadku zatrudnienia na podstawie umowy o pracę;
      • niezbędność do realizacji procesu rekrutacji oraz do podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy na podstawie art. 6 ust. 1 lit. b) RODO – w przypadku zatrudnienia na podstawie umowy cywilnoprawnej;
      • niezbędność do realizacji przyszłych procesów rekrutacyjnych na podstawie art. 6 ust. 1 lit. a) RODO – w przypadku wyrażenia dobrowolnej zgody na przetwarzanie danych osobowych w celach niezbędnych do realizacji przyszłych procesów rekrutacyjnych.
   2. wynikających z prawnie uzasadnionych interesów realizowanych przez Miquido, w szczególności zapewnienia kontaktu z Kandydatem, zawarcia z nim umowy, prawidłowowej realizacja umowy oraz ustalenia, dochodzenia lub obrony przed ewentualnymi roszczeniami na podstawie art. 6 ust. 1 lit. f) RODO;Dla celów wskazanych powyżej przetwarzane będą również dane: pozycja, na którą aplikujesz, informacja jak Nas znalazłeś, data i godzina przesłania nam Twojej aplikacji, a także inne dane, które zawrzesz w swoim CV lub przekażesz nam w trakcie rekrutacji.

3. Przekazywanie danych osobowych
   
   Twoje dane osobowe będą przekazywane wyłącznie tym podmiotom przetwarzającym, z którymi współpracujemy w oparciu o zawartą umowę lub inny instrument prawny, a także innym podmiotom powiązanym z Miquido (np. spółce matce) w oparciu o prawnie uzasadniony interes Miquido. Twoje dane osobowe mogą być udostępniane podmiotom uprawnionym do otrzymania danych na podstawie obowiązujących przepisów prawa, w tym właściwym organom wymiaru sprawiedliwości.
   
   Każdorazowo, gdy Twoje dane osobowe będą przekazywane poza Europejski Obszar Gospodarczy (EOG) do państw, które nie zapewniają takiego samego lub odpowiedniego poziomu ochrony danych osobowych, jaki wynika z przepisów obowiązujących na terenie Polski, zadbamy o to, by odbywało się to w oparciu o ważną podstawę prawną oraz z wykorzystaniem prawem wymaganych zabezpieczeń.

4. Twoje dane osobowe będziemy przetwarzać:
   • od dnia ich doręczenia do czasu zakończenia weryfikowania Twojej aplikacji oraz poinformowania Cię o wyniku tego procesu, nie dłużej niż do zakończenia procesu rekrutacyjnego – w przypadku, gdy nie udzielisz nam zgody na dalsze przetwarzanie Twoich danych osobowych dla innych procesów rekrutacyjnych,
   • od dnia ich doręczenia przez kolejne 3 lata lub do chwili wycofania zgody – jeżeli udzielisz nam zgody na dalsze przetwarzanie Twoich danych osobowych na potrzeby innych procesów rekrutacyjnych,
   • od zakończenia każdego z procesów rekrutacyjnych, w których będziesz brać udział, do upływu okresu przedawnienia roszczeń – wyłącznie w celu dochodzenia lub obrony przed ewentualnymi roszczeniami.

5. Twoje prawa
   
   Możesz skontaktować się z nami w odniesieniu do każdego z poniższych praw:
   1. Prawa do uzyskania informacji, dostępu do danych oraz do otrzymania kopii danych (art. 15 RODO),
   2. Prawa do wycofania zgody (art. 7 RODO),
   3. Prawa do sprostowania danych osobowych (art. 16 RODO),
   4. Prawa do przenoszenia danych (art. 20 RODO),
   5. Prawa do usunięcia danych i do ograniczenia przetwarzania (art. 17 i 18 RODO),
   6. Prawa do wniesienia sprzeciwu wobec przetwarzania danych osobowych (art. 21 RODO),
   7. Prawa do wniesienia skargi do organu (art. 77 RODO).
      
      W niektórych sytuacjach skorzystanie z ww. praw może nie być możliwe – mogą wystąpić sytuacje, gdy będziemy nadal uprawnieni, by przetwarzać Twoje dane osobowe.
      
      W celu realizacji któregokolwiek z ww. uprawnień prosimy o kontakt w jeden ze sposobów wskazanych na wstępie niniejszego dokumentu.
      
      Podanie danych osobowych jest dobrowolne, jednak niezbędne do przeprowadzenia procesu rekrutacji przez Miquido.

We value your trust in providing us your personal data, thus we are striving to use commercially acceptable means of protecting it. Below you will find the necessary information about the data we collect and process when you send us your application documents.

1. General informationThe controller of your personal data collected by the Website is Miquido Spółka z ograniczoną odpowiedzialnością sp. k. with its seat in Krakow, Zabłocie 43a, 30-701 Kraków, Poland (“Miquido”, “We”, “Our” or “Us”).In all cases regarding your personal data you can contact Us:

     Your personal data will be processed by the Administrator in accordance with the applicable law, in particular in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)- hereinafter referred to as “GDPR”.
     
     We guarantee the confidentiality of all personal data provided to us. We use appropriate technical and organizational safeguards, thanks to which we can ensure that the data is adequately protected against unauthorized access.

2. The purposes of the processing and legal basis
   
   We will process your personal data in order to:
   1. carry out the recruiting process – on the grounds of:
      • the necessity to carry out the recruitment process pursuant to Article 22(1) of Act of 26 June 1974 Labour Law – for employment under a contract of employment;
      • the necessity to carry out the recruitment process and to take action at the request of the data subject prior to the conclusion of the agreement pursuant to Point (b) of Article 6(1) of GDPR- for employment under a civil-law contract;
      • the necessity to carry out future recruitment processes pursuant to Point (a) of Article 6(1) of GDPR – in the case of voluntary consent to the processing of personal data for the purposes necessary to carry out future recruitment processes.
   2. fulfill objectives arising from the legitimate interests of Miquido, in particular to contact the Candidate, conclude a contract with him, correctly perform the contract and establish, investigate or defend against any claims pursuant to art. 6 sec. 1 lit. f) GDPR.
      
      Your personal data, including the job position you are applying for, information on how you found Us, the date and time of sending Us your request, and all information that you provide us with by sending your CV or during the recruitment process will also be processed for the purposes indicated above.

3. Transfer of personal dataYour personal data may be transferred only to Our data processors that we cooperate with on the basis of a contract or other legal act, or to other companies that are affiliated with Miquido (i.e. parent company of Miquido) on the grounds of Our legitimate interests as a data controller.
   
   Your personal data may be made available to entities authorized to receive data in accordance with applicable laws, including relevant judicial authorities. In each individual case when your personal data is transferred outside of the European Economic Area (EEA) to a country that does not guarantee the same or an adequate level of personal data protection that follows from the legal regulations in force in Poland, We will make sure that this is done on a valid legal basis and with the legally requiredsecurity measures employed.

4. Your personal data will be kept:
   • from the day you submit it and up to the day we finish reviewing your application and give you feedback about the results of your submission until the end of the recruiting process – in case you have not given us your consent to process it for further recruiting processes,
   • from the day you submit them and for the next 3 years or up to the day you withdraw your consent – in case you have given us your consent to process it for further processes,
   • from the end of each recruiting process you have taken part in and up to the day of the end of the limitation process of any of Our or your claims – solely for the exercise or defence of legal claims.

5. Your rights
   
   You can contact Us with respect to each of the following rights:
   1. The right to receive information and to access your data and receive copies of it (Article 15 of the GDPR),
   2. The right to withdraw consent (Article 7 of the GDPR),
   3. The right to rectification your personal data (Article 16 of the GDPR),
   4. The right to data portability (Article 20 of the GDPR),
   5. The right to erasure of data and restriction of processing (Article 17 and 18 of the GDPR),
   6. The right to object to processing (Article 21 of the GDPR),
   7. The right to file a complaint with the supervisory authority (Article 77 of the GDPR).
      
      In some cases exercising the above rights may not be possible – there may be situations where we will continue to be authorized to process your personal data.

      Providing your personal data is voluntary, but necessary in order to take part in any of the recruiting processes carried out by Miquido.
